Governor Ivey Signs COVID-19 Vaccine Bill

Date: November 12, 2021

Gov. Kay Ivey has signed Senate Bill 9, a measure saying that any Alabama employer that requires a COVID-19 vaccination must allow an employee to claim an exemption from the COVID-19 vaccination on a standard form.

The form allows for several medical exemptions and a religious exemption. The language is included in the legislation itself. Click here to read it.

If an employer denies the exemption request, the employee has the right to an appeal. The appeal is required to be filed within seven days of the denial by the employer. The employer is responsible for providing the employee information on how to file an appeal.

The employer is required to continue paying the employee until the appeal is granted or denied by the Alabama Department of Labor Administrative Law Judge. If the Administrative Law Judge denies the employee’s exemption, the employee may file an appeal to the court of competent jurisdiction.
