Small Business Continues to Push for Ambush
Rule Overturn

Federation of Independent Business (NFIB) urges the House to strike down the
NLRB union election rule forcing business owners to scramble

Washington,
D.C., March 17, 2015

The National Federation of Independent Business (NFIB) today urged every
member of the US House of Representatives to back a resolution disapproving a
pro-union rule that would condense the time for union elections from more than
a month to as few as 10 days, robbing small business owners the appropriate
amount of time to prepare. 

The National
Labor Relations Board (NLRB) recently approved a rule that would shorten the
time between when a union petition is filed and when a company must allow a
union election to take place.  The rule could force an election in as soon
as two weeks after the business is notified. Previously, business owners had a
little over a month to talk to their workers about the positive and negative
effects of unionizing and make the legal preparations necessary. Earlier this
month, the Senate passed a resolution of disapproval, under the Congressional
Review Act, to terminate the “ambush election” rule.  The rule is set to
take effect on April 14th

“That tilts the game strongly in favor of the
union because the owner has very little time to educate his workers and secure
legal counsel to help navigate the process,” said NFIB Senior Legal Counsel
Elizabeth Milito
.  “The union can plan for weeks, even months, in
advance and the owner has to scramble to catch up.”

NFIB today
sent a letter
to every member of the House urging them to pass a resolution
disapproving the rule under the Congressional Review Act. The House is expected
to vote on the resolution this week. If the House also passes the measure
it will go to the President’s desk for a final decision.

“The President would likely veto the measure, but he’ll have to explain
publicly and on the record why unions deserve another big advantage over small
business owners,” said Milito.
