NYS Department of Environmental Conservation Pauses Penalties on Zero Emission Vehicle Sales Due to Recent Congressional Action

June 2, 2025

NY is easing compliance with the state’s Advanced Clean Trucks (ACT) and Advanced Clean Cars II (ACC II) requirements.

Following Congressional action to rescind California’s ability to dictate nationwide zero-emission vehicle regulations, the NYS Department of Environmental Conservation (NYSDEC) issued an enforcement discretion letter to motor vehicle manufacturers. The letter notifies manufactures that DEC is easing compliance with the State’s Advanced Clean Trucks (ACT) and Advanced Clean Cars II (ACC II) requirements.

According to the letter, the NYSDEC is pausing penalties associated with shortfalls of zero emission vehicle (ZEV) sales during the first two years of implementation of each program – for ACT model years 2025 and 2026, and for ACC II model years 2026 and 2027.
