Federal and State Labor Poster Obligations
Employers are required by law to display, or provide with clear and visible access, state and federal labor law posters. These materials inform employees of their rights under various labor laws. It is important that employers understand what posters they display to avoid potential fines and legal penalties.
State Labor Posters
Each state has its own specific labor laws that differ from federal laws. To help you stay in compliance, NFIB has created a state workplace poster database where you can find your state-required posters.
States frequently require labor posters on:
- State minimum wage laws – Employers must post applicable state minimum wage rates.
- State family and medical leave laws – As some states have their own medical leave laws that may offer greater benefits than FMLA, employers must post their state’s family and medical leave provisions.
- State anti-discrimination laws – Somes states may have additional protections not explicitly covered by federal anti-discrimination laws. This can include sexual orientation, gender identity, or other characteristics.
- State occupational safety and health (OSH) standards – Some state OSHA regulations differ from federal rules. These state-specific safety posters must be displayed alongside federal OSHA posters.
- State worker’s compensation rules – These posters inform employees their entitlement to worker’s compensation, as well as instructions for filing a claim in the event of a workplace injury.
Some states also require posters on unemployment insurance notices, paid sick leave laws, and pregnancy accommodations.
Federal Labor Posters
At the federal level, the required posters outline fundamental employee rights. These include:
- Fair Labor Standards Act (FLSA) – This poster informs employees of minimum wage, overtime pay, and child labor laws.
- Occupational Safety and Health Act (OSHA) – This poster outline employer obligations to maintaining workplace safety.
- Equal Employment Opportunity (EEO) – The EEO poster concern federal antidiscrimination laws including the Americans with Disabilities Act (ADA), Civil Rights act, and Age Discrimination in Employment Act.
- Family Medical Leave Act (FMLA) – Applicable for employers with 50 or more employees, the FMLA poster highlights employer responsibility for providing medical leave for their employees.
