The Environmental Protection Agency (EPA) recently finalized a rule that would greatly expand the Clean Water Act to include:
- Seasonal streams
- Ponds
- Ditches, and
- Even depressions in fields.
This means water on your property might trigger regulation by the EPA. It may even mean special, expensive permits to dig, excavate or lay gravel. Violations of the act can be tens of thousands of dollars per day.

- NFIB testified before the Senate Small Business Committee on the harmful impacts of the Waters Rule on small business (Elizabeth Milito of the NFIB Legal Center on 5/19/2015)
- NFIB supports legislation that would provide relief for small businesses (S 1140 and HR 1732).
- NFIB is putting pressure on the EPA and Congress to stop this ridiculous overreach.
