NFIB Files Brief in NLRB Battle over E-Mail Use

WASHINGTON, D.C., June 17, 2014 – Yesterday, the Coalition for a Democratic Workplace, of which NFIB is a leading member, filed an amicus brief with the National Labor Relation Board (NLRB) arguing that the Board should not reverse Register-Guard. Executive Director of the NFIB Small Business Legal Center Karen Harned issued the following statement in response to the filing.

“If the NLRB reverses Register-Guard it would be handing unions a potent organizing tool, and more broadly, would be restricting employer property rights. A reversal would also hurt small business owners in a manner that will make it more difficult to provide oversight over employees, which will make it harder to ensure that employees remain productive during working time. Employers would also face new liability for employee misuse of employer-provided communication channels, along with increased risks of overloading employers’ email systems or exposing them to viruses. Employers have a right to ensure that their electronic communication systems are used solely for business purposes. We urge the NLRB to reject the General Counsel’s efforts to have Register Guard overruled.”
