The National Federation of Independent Business (NFIB), which represents 10,000
small business owners in New York and hundreds of thousands across the country,
today reacted to a decision by the New York Court of Appeals nullifying the
controversial New York City Soda Ban. Below are statements from NFIB New York State Director Mike Durant
and NFIB Small Business Legal Foundation Executive Director Karen Harned

“This is a
big win for New York City small businesses and consumers and another rebuke to
the Nanny State.

Yorkers are smart people who can decide for themselves whether and how much
soda to drink and they don’t need bureaucrats and politicians treating them
like children.

“There are
thousands of small restaurants and convenient stores in New York City who know
their customers and who should be left alone to do business.  This is an
important victory for them.  It prevents at least one very bad idea from
spilling out of the city and affecting small businesses and consumers across
the state.”

business owners and their private customers have a right to make decisions
without the supervision of disapproving busybodies in government.  This is
a rare victory for small businesses and consumers in New York and we’re very
proud to have supported the case on their behalf.”
