Gov. Kate Brown’s Big Decision Must Be Made By Tomorrow

Will she allow state to take away tax relief for small businesses?

SALEM, Ore., April 5, 2018—Tomorrow, April 6, will mark a month and four days from the time the Oregon Legislature passed Senate Bill 1528 to the time the Oregon Constitution requires Gov. Kate Brown to announce her veto of it, if she plans to veto it.

The Oregon Constitution gives the governor until next Friday, April 13, to take final action on legislation sent to her, but it requires her to announce all vetoes she plans to make by tomorrow, April 6, meaning that if she doesn’t announce her veto of SB 1528, she either plans to sign it into law or let it become law without her signature.

“We have spared no effort in letting Governor Brown know of small businesses’ visceral opposition to Senate Bill 1528, which, not to put too fine a point on it, robs Main Street, mom-and-pop enterprises of tax relief that has been in effect since January 1 of this year,” said Anthony Smith, Oregon state director for the National Federation of Independent Business. “Vetoing it would be the right thing to do for the people who gave the majority of Oregonians their first jobs in life, and who struggle each day to comply with the ever-increasing rules and regulations loaded on their backs. Signing it into law would send a resounding message throughout the country that, if small business is an Oregon priority at all, it’s right behind every other priority.”

Senate Bill 1528 was passed by the Legislature in response to the Tax Cuts and Jobs Act that passed by Congress and signed by President Trump late last year. One of the key provisions of federal tax reform is a new 20 percent deduction on qualifying business income. This new deduction would have been mirrored in Oregon’s state income tax code automatically, had the Legislature simply done nothing during the 2018 session.
