Small Business Applauds Governor Baker’s Veto of Janus “Fix” Legislation

Date: August 02, 2019

Massachusetts Legislature should do nothing to erode worker rights granted under the Janus decision

BOSTON, August 2, 2019 – NFIB has consistently criticized the so-called Janus fix legislation because it goes far beyond simply allowing public unions to recoup reasonable fees for grievances. It raises serious privacy concerns for public workers. The bill provides labor organizers access to a public worker’s private cell phone number and private email address, increasing the potential for harassment against those workers exercising their right to opt-out of compulsory union dues under the Janus court decision.

The following quotes are attributable to Christopher Carlozzi, state director of NFIB in Massachusetts:

“Governor Baker should be applauded for vetoing this very flawed piece of legislation. The Governor offered a very commonsense amendment that provided labor unions an opportunity to collect their reasonable fees, while still protecting the rights of workers. The legislature chose to pacify a handful of labor leaders, rather than address serious privacy concerns for public employees.

“Public unions have advocated for policies in Massachusetts like the $15 minimum wage, the income tax surcharge, and an overly generous paid family and medical leave benefit, all negatively impacting private employers. The United States Supreme Court helped level the playing field for small businesses and the Massachusetts Legislature should do nothing to erode worker rights granted under the Janus decision.”
