NFIB’s Small Business Legal Center on the legal aspects of social media use at work
Beth Milito, Sr. Executive Counsel for NFIB’s Small Business Legal Center, recently discussed the legal aspects of social media use in the workplace. Milito discussed the merits of establishing a social media policy, reviewing employers’ rights to monitor employees social media activity, and the rights of employees who use social media in the workplace.
Employees now use social media more and more to speak their opinions, to speak out about their employers, co-workers, and customers. Those opinions and those social media attacks have the potential to cause harm to the good-will of companies, and negatively impact the morale and reputation of employees. In recent years the National Labor Relations Board (NLRB) has acted to protect unhappy employees who use social media to wage war with employers from discipline and to expand the rights of employees to use their employers’ private email systems.
