Michigan Supreme Court to Consider Hearing on Paid Sick Leave, Minimum Wage Issues

The Michigan Supreme Court agrees to consider hearing on paid sick leave and minimum wage issues in July.

The Michigan Supreme Court is requesting further input on whether it should hold a hearing to rule on the constitutionality of the NFIB supported changes to the Paid Sick Leave and Minimum Wage ballot proposals that were made during the end of last year’s legislative session. The court will hold oral arguments on the issue on July 17, 2019 at 9:30 a.m.

NFIB, and the Small Business for a Better Michigan coalition, had previously filed amicus briefs on both the Paid Sick Leave and Minimum Wage changes with the state Supreme Court asking them to act and resolve any question of constitutionality in the legislature’s actions. The briefs were in support of Resolutions passed by the House and Senate that also asked for an immediate advisory opinion.

While there is no indication of whether the court will ultimately agree to hear the case, or whether they would rule in favor of the NFIB’s supported changes, the news is a positive sign of resolution on the issue. It is unlikely that the court would take the step to ask for more information if they were not going to hear the case, and the longer the court waits to issue a ruling the more likely they are to rule in favor of the adopted changes to the two ballot proposals since they have been in effect since March 29 of this year.
