Gov. Cuomo Signs Law Prohibiting Salary History Questions

The newly signed legislation may lead to costly results for many small business owners.

New York Gov. Andrew Cuomo signed a bill that prohibits employers from seeking salary history from applicants, which includes: 

  • The new law would also permit employees to bring lawsuits against employers in violation. The Salary History Bill will go into effect early 2020. Relying on salary history to set a new wage; 
  • Requesting salary history orally or in writing; 
  • Refusing to interview, hire, promote or otherwise employ a candidate for refusing to disclose salary history.

While supporters argue that the measure will benefit the charge for pay equality, NIFB is against the new law as small business owners will likely face the financial burden if signed into law.  

“It’s just another administrative mandate complete with additional frictional costs that will make it that much more difficult for small businesses to hire the talent they need,” said NFIB’s New York State Director Greg Biryla.
