Senate Bill 2332, the so-called Illinois Employee Security Act, would toss out decades of employment standards and make it harder for employers to discipline and discharge bad workers.
If passed, the bill would:
- Eliminate “at-will” employment.
- Limit an employer’s ability to discharge an employee for “just cause.”
- Prohibit the elimination of staff redundancy created by a merger or merger.
- Severely restrict “electronic monitoring” of a workplace.
- Restrict an employer from discharging an employee for off-duty misconduct.
- Place strict new requirements the progressive discipline process.
- Mandate employers provide severance pay for all employees, including time worked for previous employers.
- Define day- and temporary-labor services and their third-party clients as co-employers of all workers.
- Provide for extensive administrative and civil monetary remedies.
