New webinar gives the latest update on the current ADA Title III landscape

NFIB’s Americans with Disability Act Updates: Hot ADA Title III Topics and Lawsuit Trends webinar discussed the Americans with Disabilities Act (ADA) Title III trends in lawsuits around the country, and compliance. The special guests were leading ADA attorneys Minh Vu and John Egan of Seyfarth Shaw. Their firm represents virtually every industry and segment of the economy, with Vu and Egan specializing in ADA Title III issues. They joined NFIB Small Business Legal Center Executive Director Elizabeth Milito in a webinar. 

“ADA Title III compliance is a huge issue that businesses must adhere to whether it is in-person or online,” said Vu.  

The webinar discussed numerous topics, including: 

  • The current ADA Title III landscape 
  • Trends in accessibility lawsuits nationwide including website litigation 
  • How small businesses can stay compliant 

In a striking example of trends in lawsuits, Vu discusses the Acheson Hotels, LLC v. Laufer case, which centered around whether a hotel that is not being visited by the guest can be sued for not adhering to accessibility requirements. “This plaintiff sued the hotel and had no intention of even going to it,” said Vu. “The Supreme Court should rule on this in June or July of 2024.
