House Bill 380 died in the House yesterday, the last day of the Delaware legislative session. This bill was stopped due to the outcry from the
business community. Thank you to all who urged their legislators to oppose this
bill.
This bill would have limited employer access to conviction data
from criminal acts classified as “unclassified misdemeanors.” Per page 88 of
SENTAC,
unclassified misdemeanors include, but are not limited to:
- Unlawful use of consumer identification information
- Unlawful use of credit card information
- Unlawful printing credit card receipt
- Endangering children
- Sexual harassment
- Criminal Trespass 2nd Degree
Unfortunately, it is a serious reality that there are daily stories in the news about employees stealing or abusing business records and customer identification data.
If Delaware employers no longer had access to valuable public records of criminal history information for prospective employees, their business, employees and customers may be in jeopardy, opening the door for potential liability claims.
