Legislator Files Bill to Raise Minimum Wage for Tipped Workers

Rep. Elizbeth (Lisa) Hernandez (D, Cicero) filed legislation to raise the minimum wage for tipped workers.

The legislation, HB 5345, amends the Minimum Wage Law, eliminating the allowance for gratuities and requiring employers to pay tipped workers the regular minimum wage rate of the state or local government, whichever is higher.

Under current law, tipped workers are required to receive the full minimum wage, but the employer may credit tips for up to 40% of that wage rate.

The legislation, if passed, would go into effect on January 1, 2025. The current minimum wage in Illinois is $14 per hour and it will rise to $15 per hour on January 1, 2025.
