NFIB Members urged to use their Action Alert to lobby for passage of Senate Bill 84
NFIB California members have been sent an Action Alert asking them to let their state senator know of their support for Senate Bill 84.
SB 84 (Niello) aims to protect small businesses owners from aggressive litigation by providing them with the opportunity to comply with accessibility standards before facing the threat of lawsuits. It will protect small business owners from certain “shakedown” lawsuits where businesses are pressured to pay settlements for minor violations.
SB 84 focuses on reforming Americans with Disabilities Act (ADA) litigation, particularly for businesses with 50 or fewer employees. It mandates a notice-and-cure period before businesses can be sued for statutory damages in construction-related accessibility claims. This means businesses must be given a 120-day window to address ADA accessibility issues before a lawsuit can be filed.
