NFIB Files Comments on Illinois Proposed Paid Leave Rules

NFIB filed written comments on the Department of Labor’s proposed rules to implement the Paid Leave for All Workers Act (the Act). The Act, which passed in the Illinois General Assembly in January 2023, imposes a new paid-leave mandate on the majority of employers across the state. Employers will be required to provide their employees with, at minimum, 1 hour of paid time off for every 40 hours worked, up to a minimum of 40 hours of paid leave per year. NFIB contended in its public comments that the proposed rules would impose unnecessary administrative costs upon small businesses, did not provide sufficient leeway for employers to implement reasonable guidelines for paid-leave requests, and went beyond both the statutory language and legislative intent of the Act. The written comments can be accessed here: NFIB Comments on DoL Proposed Rules for the PLFAW Act The Act will go into effect on January 1, 2024, but the Department of Labor does not anticipate finalizing its rules until March 2024, leaving a gap between the mandate going into effect and the state finalizing its guidance to employers scrambling to comply with the new requirements. <<<<<To learn more about the Act, watch NFIB’s webinar on the Paid Leave for All Workers Act.>>>>>
