May 4, 2026

Employers cannot consider credit history information

Starting April 18, New York State will prohibit employers from requesting or using consumer credit history when making decisions about hiring, compensation, or promotions. This means that employers cannot consider an applicant’s or employee’s credit reports, scores, bankruptcies, or payment history when making these decisions. Additionally, background screening agencies are barred from supplying credit history information unless an exemption applies.
