With the Michigan Supreme Court named to the American Tort Reform Foundation’s ‘Judicial Hellholes’ Watch List, NFIB Michigan State Director Amanda Fisher issued the following statement:

“Small business owners are not surprised to see the Michigan Supreme Court remain on the ‘Judicial Hellholes’ list as part of their Watch List. Small business owners are worried about the upcoming decisions from the Supreme Court and understand the real-life implications of its decisions,” Fisher said. “Not only are small employers concerned about the Supreme Court’s rulings, but they are becoming more troubled about the increase in frivolous lawsuit abuse happening statewide and the cost to defend themselves from these predatory practices.”

The Michigan Supreme Court moved to the Watch List from ranking #8 in the 2024 report, largely because it hasn’t issued several long-awaited decisions. While small employers await those decisions, owners are concerned about legislation moving in the Senate that would open the Consumer Protection Act and intensify the lawsuit abuse occurring in the state.

NFIB members have advocated for important and much-needed legal reform to restore fairness and balance in Michigan’s legal system. NFIB recently launched the Michigan Alliance for Legal Reform with a coalition of business groups to advance legislative solutions to lessen lawsuit abuse in the state.
