JCAR, a Key Illinois Legislative Committee, Signs Off on Paid Leave Rules

The Joint Committee on Administrative Rules (JCAR) signed off on the Department of Labor’s proposed administrative rules for the Paid Leave for All Workers Act after the Department—following further discussions with stakeholder groups—agreed to additional revisions to its proposed paid-leave rules.

The revisions provide greater clarity on employer rights under the act. With the new revisions, the Department has addressed the issues raised by NFIB in its public comments in December.

These changes include:

  • Greater clarity and flexibility on when an employer may deny paid leave under the act.
  • Simplification of employer workplace posting requirements.

These changes are in addition to the NFIB-advocated revisions incorporated into the first revision of the proposed rules released in February.

The paid-leave mandate went into effect on January 1, 2024. NFIB was the only statewide business association that consistently opposed the final paid-leave bill when it was under consideration by the Illinois General Assembly.

JCAR is a bipartisan and bicameral committee of legislators that reviews the state’s administrative rulemaking process.
