Indiana General Assembly Session Update

Indiana General Assembly Session Update

January 5, 2026

Read about what legislation NFIB is monitoring

The Indiana General Assembly returned to session on Monday, January 5, to continue the legislative session that began in December. While most of the news has been focused on redistricting, NFIB is monitoring several other issues like tax conformity, energy, legal reform, and state-mandated regulations. Read more about each issue below.

Tax Conformity

Small business owners worked relentlessly to get the 20% Small Business Deduction made permanent in the One Big Beautiful Bill Act, which Congress passed last summer. Now, Indiana lawmakers are considering legislation to conform Indiana’s tax code to the federal rules. NFIB is strongly advocating for the protection of the 20% Small Business Deduction for Indiana’s small business community. TAKE ACTION: Tell Indiana lawmakers to adopt the 20% Small Business Deduction and provide certainty for the small business community!

Energy

Energy is a main topic that the General Assembly will be paying attention to for the next several years. The Indiana Strategic Energy Growth Task Force will be making recommendations for new policies that address ways to respond to Indiana’s increased energy demands. Stay tuned for more information.

Legal Reform

Frivolous lawsuits and rising business insurance costs are a major concern for small businesses throughout Indiana. NFIB is working with several other business advocacy groups to promote comprehensive legal reform. TAKE OUR SURVEY: If you have experienced a frivolous lawsuit or rising insurance costs, please let us know.

State-Mandated Retirement Program

The General Assembly is considering legislation that would create a state-mandated retirement program for all small businesses. The program would automatically enroll employees of businesses who have not offered a qualified retirement program to employees in the previous year. More information about joining the fight against government overreach will be forthcoming.
