NFIB Weighs in on Legal Battles Impacting Small Businesses

NFIB Weighs in on Legal Battles Impacting Small Businesses

June 3, 2026

NFIB stands behind small businesses on key legal issues

The NFIB Small Business Legal Center issued legal briefs in several critical small business cases. The issues include greenhouse gas hearings, credit card swipe fees, and First Amendment rights. Learn about these cases and how they affect small business.

  • Suncor Energy v. Boulder County:

This case involves whether federal law prevents state claims from individuals seeking relief for injuries allegedly caused by greenhouse gas emissions. NFIB’s amicus brief argues that the Supreme Court has the authority to hear the case, and allowing state claims sets a dangerous precedent, jeopardizing the courts, the fuel industry, small businesses involved, and the entire U.S. economy. This case is ongoing in the United States Supreme Court.

  • Linney’s Pizza v. Federal Reserve:

This case challenges a federal reserve rule that allows banks to charge excessive fees on debit card transactions. Swipe fee costs have become one of the top overhead costs for small businesses. NFIB’s amicus brief argues a violation by allowing banks to recover unreasonable profits, resulting in record profits for banks and markedly higher costs for businesses and consumers. This case is currently at the U.S. Court of Appeals for the Sixth Circuit.

  • Cozy Inn v. Salina:

This case focuses on First Amendment rights for artistic expression for small businesses. NFIB’s amicus brief supports Cozy Inn, a small business displaying a mural, arguing that artistic expression does not lose its protection under the First Amendment just because its economic motivation, and complying with the city of Salina’s sign code is burdensome for small businesses. NFIB urges the U.S. Court of Appeals at the Tenth Circuit to uphold a previous ruling and protect the First Amendment rights of small businesses.

The NFIB Small Business Legal Center remains committed to protecting and fighting for the rights of small businesses nationwide. NFIB is involved in more than 40 cases across Federal and State courts, including the U.S. Supreme Court. Reach out to the NFIB Small Business Legal Center at info@nfib.org with any questions.
