This case involves whether federal law prevents state claims from individuals seeking relief for injuries allegedly caused by greenhouse gas emissions. • Linney’s Pizza v. Federal Reserve: 

This case challenges a federal reserve rule that allows banks to charge excessive fees on debit card transactions. Swipe fee costs have become one of the top overhead costs for small businesses. NFIB’s amicus brief argues a violation by allowing banks to recover unreasonable profits, resulting in record profits for banks and markedly higher costs for businesses and consumers. This case is currently at the U.S. Court of Appeals for the Sixth Circuit.

• Cozy Inn v. Salina: 

This case focuses on First Amendment rights for artistic expression for small businesses. NFIB’s amicus brief supports Cozy Inn, a small business displaying a mural, arguing that artistic expression does not lose its protection under the First Amendment just because its economic motivation, and complying with the city of Salina’s sign code is burdensome for small businesses. NFIB urges the U.S. Court of Appeals at the Tenth Circuit to uphold a previous ruling and protect the First Amendment rights of small businesses.
