Predatory lawsuits target small businesses

Frivolous lawsuits are targeting small businesses for alleged Americans with Disabilities Act (ADA) violations on their websites, forcing small business owners to settle or fight the lawsuits in a prohibitively long and costly court battle. Mary Alex Hamby, NFIB Principal of Federal Government Relations, penned an opinion piece in the Washington Examiner exploring the struggles small businesses endure with these predatory lawsuits and how Congress can provide protections.
Missouri recently passed a law to fight lawsuits filed under the guise of ADA violations, giving small businesses time to correct any alleged accessibility issues before facing legal action. Several bills have been introduced in Congress to limit frivolous lawsuits filed against small businesses, including the Protecting Small Businesses from Predatory Website Lawsuits Act and the ADA 30 Days to Comply Act.
Small business owners are not safe as long as trial lawyers are able to continue demanding money to settle claims over choices such as color schemes and fonts small businesses use on their websites without the chance to adjust. Both of these proposed bills give small business owners appropriate time to correct any alleged compliance issues with their website. Now, Congress must work to pass legislation to shield small businesses from frivolous and baseless litigation.
