NFIB to Key Vote legislation against new regulation change
WASHINGTON, D.C. (Jan. 12, 2024) – The National Federation of Independent Business (NFIB), the nation’s leading small business advocacy organization, applauds the passage of H.J.Res 98, Providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the National Labor Relations Board relating to “Standard for Determining Joint Employer Status” in the U.S. House of Representatives. The legislation is considered an NFIB Key Vote for the 118th Congress.
“Small business owners succeed when there are clear and consistent guidelines,” said Adam Temple, NFIB Senior Vice President of Advocacy. “The new joint employer rule brings one more burdensome regulatory change that is complicated for small businesses to navigate in conjunction with ongoing economic challenges. NFIB is also concerned that the new standard will have unintended consequences for small businesses outside of the franchise model and may subject employers to new liabilities if third parties ‘deemed joint employers’ violate labor laws. We thank the U.S. House for passing this legislation disapproving the new joint employer rule.”
NFIB opposed the final rule from the National Labor Relations Board issued in October 2023. Previously, NFIB supported the 2020 joint employer rule which simplified the determination of joint employer status.
