Overtime Eligibility, Lawsuit Actions Among NFIB Legal Center Amicus Filings
The NFIB Small Business Legal Center filed amicus briefs throughout November and December in courts nationwide dealing with important small business issues. Three highlighted cases include:
- Mayfield v. DOL, filed at the Fifth Circuit Court of Appeals, argues that the Department of Labor (DOL) does not have the authority to impose a salary threshold that determines overtime eligibility for executive, administrative, or professional (EAP) employees.
- Corner Post v. Federal Reserve, filed at the U.S. District Court for the District of North Dakota, argues against swipe fees set by the Federal Reserve.
- Dale v. AU Medical Center, filed at the Georgia Supreme Court, argues that an action is initiated when a lawsuit is brought, not at the time of the trial, and the defendants named in the suit should not lose the capability to assign responsibility if they are the remaining defendant by the date of the trial.
