New York Updates Sexual Harassment Prevention Policy and Training

The New York State Department of Labor (NYSDOL) released its updated Sexual Harassment Prevention Policy. As a result of 2018 amendments to the law, the State must revise its model policy every four years. The NYSDOL also updated its training materials on preventing sexual harassment and discrimination. Key changes include how to address harassment in a remote environment, “bystander intervention”, definitions of different gender identities, and an expansion on gender discrimination and retaliation in the workplace. Employers should carefully review updated guidelines and be aware as they continue annual training. Under current New York State law, employers are required to provide employees with a sexual harassment and workplace-discrimination prevention policy, a copy of the policy at the time of hiring, and annual sexual harassment and discrimination prevention training.
