TAKE ACTION: Lawmakers Take Up Small Business Bills

Lawmakers are weighing several bills that could help improve the affordability and insurance options for LA small businesses

The House and Senate are considering several bills that could help improve the affordability and availability of insurance coverage for Louisiana. The measures include:

House Bill 337: Repeals the current direct-action statute against insurers except in specific, limited circumstances to ensure juries better understand and evaluate the reasonableness of any damages awarded, thereby attracting more insurers to Louisiana.

House Bill 423: Deletes the requirement that the courts award the claimant 40% of the difference between the amount billed and the amount paid.

Senate Bill 250: Repeals Louisiana’s statute, which allows a plaintiff to sue the insurance company of the party at fault. (Louisiana is one of only three states that allow the plaintiff to name the insurer instead of the at-fault party when filing a lawsuit.)

Senate Bill 295: Provides for certain processes relative to rate making. (The bill enacts that the Insurance Commissioner reviews rate filings and would approve or disapprove the rates.)

Senate Bill 323: Establishes a process for good faith and fair dealing in insurance claims handling.

Senate Bill 370: Provides for terminating certain property, casualty, or liability policies.
