Illinois Department of Labor Makes Changes to Proposed Paid Leave Rules

After reviewing public comments, the Department of Labor revised its proposed rules for the Paid Leave for All Workers Act.

The revisions included issues that NFIB had highlighted in its public comments, including:

  • The revised rules no longer require employers to include accrued leave on every pay stub.
  • The revised rules now permit employers to require employees to submit leave requests in writing.
  • The revised rules cleaned up some ambiguous and confusing language concerning the required rate of pay for employees on paid leave.
  • The revised rules now permit employers to restrict the amount of accrued paid leave that employees can carry over to 40 hours (the original draft rules permitted employees to carry over 80 hours)

The rules still include unclear language and NFIB will continue to advocate for further clarification.

A copy of the proposed rules that the Department of Labor submitted to JCAR can be found HERE. JCAR is scheduled to consider these rules on March 12, 2024.
