Governor Kemp Signs 'Freedom to Farm Act'

Gov. Brian Kemp has signed House Bill 1150, also known as the Freedom to Farm Act. NFIB State Director Nathan Humphrey joined Governor Kemp and lawmakers on April 13 at a signing ceremony at Dickey Farms, an NFIB member business in Musella. “This is a major victory for Georgia farmers,” Humphrey said. The measure protects farmers from nuisance lawsuits brought by neighboring property owners who moved into existing agricultural areas, he said. The bill was carried in the House by Dickey Farms owner Robert Dickey and in the Senate by NFIB member Larry Walker, who owns the Walker Insurance Agency in Perry. “This is something we’ve been working on for many years,” Humphrey said. “HB1150 will provide reasonable protections to farmers from frivolous nuisance claims.” “This act doesn’t exempt a business or farm from any existing laws or regulations,” Humphrey said. “It simply provides clarity and protections for many of our state’s small businesses and the agriculture industry.”
