New Rule Changed to Help Employers on Background Checks

Restrictions on Employee Background Checks Defeated

A new rule created by the Michigan Supreme Court would have prohibited employers from using birthdate information when doing background checks on prospective employees. Birthdates are key for doing background checks to ensure the information gathered is on the correct individual. The rule was scheduled to go into effect on January 1, 2022, but quick action by NFIB and other business organizations changed the rule so that companies that do background checks can register and have access to birthdates and other pertinent information. The new rule does not go into effect until April 1, 2022, to give companies time to meet the change.
