NFIB Statement on MI Supreme Court's Decision to Hear Arguments on “Adopt and Amend” Case

FOR IMMEDIATE RELEASE LANSING, MI (June 21, 2023) – The National Federation of Independent Business (NFIB), the state and nation’s leading small business advocacy organization, released the following statement today by State Director Amanda Fisher regarding the decision by the Michigan Supreme Court to hear arguments on the constitutionality of the Legislature to adopt a citizen-initiated referendum and then amend the language in the same session. This case relates legislative action taken on the paid sick leave and minimum wage proposals of 2018. “In January of this year, when the Appeals Court unanimously (3-0) declared that ‘adopt and amend’ was indeed constitutional, NFIB anticipated that this matter was settled. Instead, Michigan small business owners are left with uncertainty and trepidation as the catastrophic threat to employers from the original proposals continues to hang over their heads. “We are hopeful that the Michigan Supreme Court, after considering both sides carefully, will uphold the Appeals Court ruling, and thus make sure the Legislature retains the power conferred by the constitution.”
