New Department of Labor Policy on Breast Milk Expression in New York Effective June 7th

Legislation signed by Gov. Kathy Hochul last year requiring ALL employers, regardless of size, to provide expanded accommodations for breast milk expression became effective June 7th. The legislation requires employers to follow policies developed by the New York State Department of Labor establishing employee rights when expressing breast milk in the workplace. Under this new law, employers must provide all employees with a copy of the New York State Department of Labor Policy on Breast Milk Expression in the Workplace and inform employees about their right to take unpaid breaks during the workday to express milk at the time of hiring, once a year after hiring, and when an employee returns to work after the birth of a child. Any written request from an employee for a location to express breast milk in the workplace must be responded to within five business days. Employers must also provide clean, private, convenient, pumping accommodations in the workplace that include natural light, a table or flat surface, and access to clean running water and an electrical outlet nearby.
