Illinois Department of Labor Withdraws its Proposed Day & Temporary Worker Rules

The Illinois Department of Labor withdrew its proposed rules for the Day & Temporary Labor Services Act. The proposed rules, which were filed in August of 2023, received widespread backlash. NFIB in its public comments on the proposed rules argued that they further complicated a confusing statute and were “inconsistent with” and went beyond the “scope of the enacted legislation.” The rules were in response to PA 103-0437. Recognizing the problematic nature of PA 103-0437, the Illinois General Assembly passed new legislation this spring, modifying and clarifying some aspects of the act. This legislation, SB 3650, has been signed into law by the governor as PA 103-1030. PA 103-0437 has also been challenged in federal court by a number of staffing agencies and associations, leading a federal judge to enjoin the enforcement of one portion of the act while the litigation proceeds.
