Stop Abusive Lawsuits

Protect Hardworking Georgia Small Businesses

Right now, some personal injury lawyers target Georgia’s small businesses – businesses that often operate on thin margins without much extra income or savings. Even if a lawsuit is groundless and ultimately thrown out, the cost of just one court defense can be high enough to force a small business to close its doors. The General Assembly is debating Senate Bill 68 (SB 68), commonsense legislation that would stop abusive lawsuits in Georgia.

SB 68 helps small businesses by:

Limiting outrageous damages in injury cases by allowing a jury to know the costs of medical bills the plaintiff actually paid.

Updating procedural processes by making it easier for a judge to throw out a frivolous case and requiring juries to decide liability and damage awards separately to curb emotionally-inspired nuclear verdicts.
Strengthening current statutes to ensure small businesses are not unfairly held responsible for crimes beyond their control and often not even on their property.
Allowing juries to know whether failing to wear a seat belt contributed to someone’s injuries.

Small businesses already manage rising costs, worker shortages, and economic uncertainty. They shouldn’t be forced to defend themselves against groundless claims.
