Small Businesses Support Legislation to Prevent Energy Bans

The Energy Choice Act would prohibit bans on energy products and services

WASHINGTON, D.C. (Sept. 23, 2025) – The National Federation of Independent Business, the nation’s leading small business advocacy organization, sent a letter to the U.S. House of Representatives in support of H.R. 3699, the Energy Choice Act, legislation that would prohibit state and local governments from banning energy services based on the type or source of energy, thereby reducing energy costs and ensuring that small businesses nationwide have a choice in their energy provider.

“The cost of energy remains a top issue impacting our nation’s small businesses,” said Louis Bertolotti, Principal of Federal Government Relations. “To encourage the use of certain energy sources over others, states and municipalities throughout the country have implemented burdensome restrictions that have decreased access to affordable, reliable energy sources. This legislation will prevent these one-size-fits-all mandates from wreaking further havoc on small businesses and their local economies as electricity demands continue to break peak records.”

NFIB members consistently rank the cost of energy as a top operating concern for their small businesses. In NFIB’s most recent Problems & Priorities survey, small businesses ranked the cost of natural gas, propane, gasoline, diesel, and fuel oil as their 6th most pressing issue, with electricity costs following at 10th overall.
