NFIB Urges Governor Landry to Sign Key Insurance Reforms into Law

The measures would make Louisiana's legal syster fairer for everyone

The National Federation of Independent Business (NFIB) is urging Gov. Jeff Landry to sign legislation that would help curb lawsuit abuse and bring down insurance costs for Louisiana’s small businesses.

“Governor Landry has a real opportunity to stand up for Louisiana’s small business owners by signing these measures into law,” NFIB State Director Leah Long said. “These common-sense reforms will help rein in the legal system and make it fairer for everyone, not just those looking for a payout.”

The Louisiana Senate last week gave final approval to the three NFIB-supported measures:

  • HB 431 by Rep. Emily Chenevert would enhance accountability in our justice system by barring the recovery of damages if the claimant is 51% or more at-fault in an accident.
  • HB 434 by Rep. Jason DeWitt would apply a “no pay, no play” provision with a $100,000 cap, limiting recovery for uninsured drivers.
  • HB 450 by Rep. Michael Melerine would end the so-called Housley Presumption, requiring injured parties to prove that an accident caused their injuries rather than assuming it.

“These changes are long overdue,” Long said. “Lawsuit abuse drives up the cost of doing business and discourages growth. These bills will help restore balance to the legal system and give small business owners a fair shot.”
