New Jersey Small Businesses Oppose New Independent Contractor Rule

The proposed rule would complicate independent contractor classification for small businesses

TRENTON, N.J. (July 18, 2025) – The National Federation of Independent Business (NFIB) submitted a comment letter to the New Jersey Department of Labor and Workforce Development in response to a proposed rule that would alter the classification of independent contractors in the state. NFIB asks the Department to consider the impact of these regulatory changes on New Jersey’s small businesses and urges them to withdraw the proposed rule.

“This rule adds layers of complexity to an already confusing process,” said Eileen Kean, NFIB New Jersey State Director. “Small businesses throughout the Garden State need clarity and stability from their governing bodies. They do not need this onerous process further complicated by expanded definitions and vague situational factors that make it more difficult to determine how to classify their workers.”

The NFIB Small Business Legal Center protects the rights of small business owners in the nation’s courts. NFIB is currently active in more than 40 cases in federal and state courts across the country and in the U.S. Supreme Court.
