Minnesota to Mandate Adult Changing Tables in Some New, Remodeled Buildings

Minnesota to Mandate Adult Changing Tables in Some New, Remodeled Buildings

During the 2023 Minnesota Legislative Session, state Rep. Kim Hicks (DFL-Rochester) introduced a bill mandating the installation of adult changing tables on each floor of a building where there is a publicly accessible restroom. While accessibility for those with physical or mental impairments is a sensitive topic, NFIB and other business groups strongly objected to this proposal, which would have been incredibly costly and impractical for small business owners. Ultimately, lawmakers adopted a narrower version of the mandate and this month the Minnesota Department of Labor and Industry (DLI) is beginning the rulemaking process. The rule will apply when covered facilities are newly constructed or undergo a substantial remodel (e.g., updating bathroom in a facility that is subject to the rule). The specifications for adult changing tables in facilities subject to the mandate require the changing table to support not less than 400 pounds, be equipped with controls allowing the bed to be adjusted to a height of 17 inches to 38 inches from the floor, and have a minimum surface of 70 inches by 30 inches.
