NFIB successfully advocated for a delay in MA’s Advance Clean Truck (ACT) rule.
Last year, NFIB was part of a coalition that successfully advocated for a delay in the state’s Advance Clean Truck (ACT) rule that sought to limit the number of non-electric medium and heavy-duty trucks operating in Massachusetts. This California based policy was demonstrated to be unworkable because the state lacked the infrastructure for electric trucks, the technology and inventory did not exist to meet the needs of some businesses, and the higher cost of purchasing electric trucks.
Now, the Department of Environmental Protection’s (DEP) Bureau of Air and Waste is seeking to amend this rule by delaying the enforcement for another year until 2027. While this is good news, NFIB submitted comments urging the department to go beyond that 2027 timeframe since the rule is still going to be unworkable without the appropriate inventory, technology, affordability, and infrastructure. NFIB noted that many small businesses rely on medium and heavy-duty trucks, and if this rule goes into effect in 2027 it will make it more difficult and more expensive to run a business in Massachusetts.
