In 2025, Governor Kathy Hochul directed the Department of Environmental Conservation (DEC) to develop a mandatory Greenhouse Gas (GHG) Reporting Program to help meet the state’s 2019 Climate Leadership and Community Protection Act (CLCPA) goals. In March 2025, the DEC released draft regulations and invited public comments.
Beginning in 2027, businesses emitting 10,000 metric tons of CO₂ annually, including power plants, landfills, fuel suppliers, industrial facilities, some agricultural suppliers, and waste-to-energy facilities, will be subject to reporting requirements (reflecting GHG emissions). Some larger emission sources will require DEC-accredited third-party verification annually. The finalized regulation extends the verification reporting deadline for the first two years of the program, changes the reporting requirement from three years to one year for reporting from closed facilities, and aligns some terms and definitions with federal reporting requirements.
