The eight best and worst measures for small business
Good for Small Business Bills
— Assembly Bill 24 (DeMaio) “… would balance the budget by cutting then capping the total annual labor costs [and] requiring that both the state budget as a whole and any new program fees be approved by a 2/3 vote of the Legislature.”
— Senate Bill 628 (Grove) “… would authorize an employer to claim a credit in an amount equal to the amount of overtime wages, as defined, paid during that quarter to specified agricultural employees covered by a certain wage order.”
— Senate Bill 84 (Niello) “… would provide that a defendant is not liable for statutory damages, plaintiff’s attorney’s fees, or costs for an alleged violation that is corrected within 120 days of service of a letter alleging the violation.”
Bad for Small Business Bills
— Senate Bill 590 (Durazo) “… would … expand eligibility for benefits under the paid family leave program to … define designated person to mean any individual related by blood or whose association with the employee is the equivalent of a family relationship.”
— Senate Bill 310 (Wiener) Wage Theft. “This bill also would permit the penalty to be recovered through an independent civil action, as specified.”
— Senate Bill 555 (Caballero) Cost of living adjustments for workers’ compensation recipients.
— Senate Bill 261 (Wahab) concerning wage theft and other labor laws. “This bill would require the commissioner to post a copy of the order, decision, or award on the division’s internet website, as specified, no later than 15 days after the time to appeal from the order, decision, or award has expired and no appeal therefrom is pending.”
Ugly Bills
— Senate Bill 809 (Durazo) “… would provide that mere ownership of a vehicle, including a personal vehicle or a commercial vehicle, or other tools, used by a person in providing labor or services for remuneration does not make that person an independent contractor.”
