NFIB Key Votes bill to clarify water regulations
What it means: NFIB issued a Key Vote for a bill to clarify what waterways are considered Waters of the United States (WOTUS) and whether or not those waters will require permits from the Environmental Protection Agency (EPA) to develop. Any small business owner who owns land with any sort of water on it, no matter how minor, may be affected by WOTUS.
Our take: Small businesses need clarity to operate and plan for the future. Small businesses have been fighting against this government overreach and pushing for guidance on requirements.
Take action: Urge the Senate to support the PERMIT Act to end excessive government regulation and provide certainty.
Any small business owner who owns land with any sort of water on it has faced uncertainty around permit requirements for many years. H.R. 3898, the Promoting Efficient Review for Modern Infrastructure Today (PERMIT) Act seeks to resolve many of the issues small businesses have endured from the Clean Water Act (CWA). NFIB sent a letter to the U.S. House of Representatives in support of the PERMIT Act and announced it as an NFIB Key Vote for the 119th Congress.
“By clarifying what falls outside of the scope of the CWA, this bill removes the ambiguity that has wreaked havoc on permitting decisions for decades,” said Adam Temple, NFIB Senior Vice President for Advocacy.
This bill, H.R. 3898, will eliminate redundant requirements and other common pitfalls that prevent small businesses from planning for future business operations. These clarifications will simplify the process when attempting to secure permits from the EPA, while allowing small businesses to invest with confidence without being held back by unnecessary regulations.
By clearly defining what does and does not require a permit from the EPA, the PERMIT Act will help protect small businesses from the threat of government overreach and litigation.
