Wisconsin Legislature to Vote on Consumer Data Protection

The State Assembly will consider a proposal that would establish regulations to control processing the personal data of consumers.   Assembly Bill 466, introduced by Representative Shannon Zimmerman (River Falls) and Senator Romaine Quinn (Cameron), would create compliance requirements for businesses and specific rights for consumers relating to use of their personal data.   Representative Zimmerman says, “The Wisconsin Data Privacy Act will enshrine in Wisconsin Statutes rights that will help consumers protect and control their personal data.”   Notwithstanding a provision that would exempt some small businesses, NFIB is concerned Assembly Bill 466, while well intentioned, would create costly, confusing compliance issues for businesses and consumers.   NFIB has joined with Wisconsin Manufacturers and Commerce, Wisconsin Restaurant Association, Wisconsin Fuel and Retail Association, and Wisconsin Hotel and Lodging Association to oppose passage of AB 466 because it would increase costs for businesses and exacerbate the increasing patchwork of regulations across the country, creating more confusion for consumers and businesses alike.   According to the Information Technology and Innovation Foundation, complying with privacy laws across the country is estimated to cost $2.8 billion, $600 million of which falls on Wisconsin’s small businesses.
