What it means: The U.S. House passed the bipartisan Prove It Act which strengthens requirements for government agencies to analyze the impact their regulations will have on small businesses. This was considered an NFIB Key Vote for the 118th Congress.

Burdensome one-size-fits-all regulations remain a problem for small businesses that have to stay in compliance, which takes time away from owners running their business. The U.S. House of Representatives passed the Prove It Act, H.R. 7198, to ensure government agencies analyze the impact of regulations on small businesses. NFIB sent a letter to the U.S. House of Representatives in support of the legislation, which was considered an NFIB Key Vote for the 118th Congress.
The bipartisan legislation would strengthen the requirements for agencies to consider the economic impact on small businesses before adding new regulations. The legislation would also increase small business engagement in the regulatory process. A White Paper analysis by the NFIB Small Business Legal Center explores the lack of Regulatory Flexibility Act (RFA) compliance by administrative agencies and what Congress can do to reinvigorate the RFA as a constraint.
NFIB previously sent a letter of support to members of Congress and led a coalition letter with 50 trade associations urging Congress to fulfill the intent of the RFA through legislation like the Prove It Act.
