NFIB Texas Wary of Efforts to Redefine Tax Code Outside of Legislative Process

Last week, NFIB Texas attended a public hearing held by the Comptroller on a proposal amending the sales and use tax. The proposal seeks to address the location where an order is received on behalf of a seller.

  

Unfortunately, this amendment does little to address the larger problem: the fundamentally flawed rule of the sales and use tax. These proposals, the sixth suggested definition since 2019, don’t provide greater clarity or consistency for Texas business owners.

 

The tax code should not be subject to redefinition by the Comptroller’s office. If the tax code is going to undergo significant changes, it should happen through the legislative process.

 

NFIB Texas plans to submit a written comment to the Comptroller’s office on this proposed language change. We will continue to monitor proposals amending the sales and use tax, and fight on behalf of small business owners across the state.
