New York Sees Spike in Frivolous ADA Lawsuits

The Americans with Disabilities Act (ADA) is a federal law passed in 1990 prohibiting discrimination against individuals with disabilities. A less widely known ADA issue has begun to pick up significant steam, especially in New York: ADA website litigation. New York has seen a persistent stream of ADA website demand letters and complaints filed in recent years. New York has distinctly emerged as the central hub, accounting for a considerable number of these ADA legal challenges. In total, 1,517 ADA lawsuits were filed in New York courts this year (January 2023-August 2023). New York lawsuits have been filed by a relatively small number of firms on behalf of blind plaintiffs who make vague allegations about how they could not access the goods and services on dozens, if not hundreds of websites with little to no information about what goods and services the plaintiffs actually wanted to or why they needed them.
