Issues Facing Georgia Small Businesses
- HB 808: Tangible Personal Property; de minimis threshold increase – bill introduced by Rep. Cheokas that would raise the exemption threshold for tangible personal property tax from $7,500 to $50,000. This bill is a referendum and would require a 2/3rds vote by the legislature and approval by the voters.HB 808 was introduced after Crossover Day and will be available next year for consideration.
- SB 126: Consumer Inflation Reduction and Tax Fairness Act – our swipe fee bill where card networks would be prohibited from charging interchange fees on any amount other than the base price of goods and services, thereby banning swipe fees on sales and excise taxes.This bill was not called up for a vote in the Senate Banks and Banking Committee and is still alive for next year.
- SB 186: Georgia Landowners Protection Act – would revise the premises liability law to limit the cause of action available to invitees, licensees, and trespassers injured on a landowner’s property. This piece of legislation would ensure only injuries resulting from the willful, wanton, or intentional conduct of a non-agent third party will be sufficient to bring a lawsuit. NFIB supports legislation that protects Georgia citizens, investors, and businesses from punitive judicial decisions that do not emanate from an actual harm or loss.SB 186 passed out of the Senate Insurance and Labor Committee, was not called up for a vote on Crossover Day, and is still alive for next year.
