Pennsylvania Summer Legislative Update

Learn the latest from Harrisburg on legislation impacting Main Street

Lawmakers have been busy at the Capitol passing a wide range of bills, several of which will have an impact on Pennsylvania’s small businesses. Below is a current breakdown of the legislation NFIB is tracking:

  • SB 908: Prevailing Wage / Split Rate Manufacturing – Passed the Senate 37-13 with bipartisan support. This legislation would extend prevailing wage protection to off-site custom fabrication work for public construction projects.
  • SB 906: 20-week Paid Leave / Employee Paid – Advanced out of the Senate Labor & Industry Committee in a 9-2 vote. It’s not expected to receive a vote on the Senate floor. The legislation would establish a statewide paid family and medical leave program.
  • HB 1678: Digital Ad Tax – Passed the House 139-63. The legislation would extend Pennsylvania’s existing 5% gross receipts tax to cover companies and corporations that provide digital advertising services in the state.
  • HB 2300: Real-time Sales Tax Remittance (only for delinquent filers) – Passed the House 153-48. This bill is only for delinquent filers and would enroll those filers in a program that would automatically send their sales tax to the state.
  • HB 2388: Penny Rounding Bill – Passed the House Commerce Committee 26-0. The legislation provides guidance on how to round physical cash payments to the nearest nickel to account for the cessation of penny production.
  • HB 2207: Agriculture Lending Bill – Passed the House Commerce Committee 26-0. The bill would increase the maximum PIDA small business loan projects from $400,000 to $2,000,000.
  • HB 2550: ICHRA Tax Credit – Passed the House 200-2. This legislation creates the Small Business Health Care Premium Contribution Tax Credit, allowing Pennsylvania small employers with fewer than 50 employees to claim a state tax credit if they contribute to their employees’ health insurance premiums.

 

NFIB’s Pennsylvania Team will continue to monitor legislation moving in the General Assembly, including the state budget due in a few weeks. Owners are encouraged to contact their legislators on important issues still pending:

  • PAID LEAVE – New proposals on a statewide paid leave program continue to circulate. Act now and tell your lawmakers you can’t afford a mandated statewide paid leave program!
  • UNEMPLOYMENT FOR STRIKING WORKERS – Lawmakers are considering a bill that would make striking workers eligible for Unemployment Compensation Benefits. Tell your legislators you do not want an increase in unemployment benefits for people who are employed!
  • BALANCED BUDGET – Governor Shapiro’s 2026 budget proposal calls for increased state spending that would create a $4.5 billion deficit. Urge lawmakers to pass a balanced budget with no tax increases on small businesses!
  • MINIMUM WAGE INCREASE – Lawmakers are considering a minimum wage increase as Gov. Shapiro proposed a new plan that would increase the minimum wage to $15 by 2029 and rise automatically based on inflation. Tell your legislators the cost of doing business is already rising, and you cannot afford an increased minimum wage!
