Employers with 10 or more employees are affected by the state-run retirement program
Employers with ten or more employees who physically work in New York and do not offer a retirement plan are required to offer the state-run retirement program, known as the New York Secure Choice Program, to their employees. Employers with 30 or more employees must register by March 19th; employers with 15 to 29 employees must register by May 15th, 2026; and employers with 10 to 14 employees must register by July 15th, 2026. If you have not yet registered, you will need your federal employer identification number (EIN) and your unique Access Code sent to you from the Secure Choice Retirement Savings Program. If you have already signed up, New York Secure Choice will notify you when it’s time to register your business.
